iFone Repair Service Terms and Conditions

1. REPAIR AGREEMENT:

iFone Repair Service will repair your device as described for the charges stated and written on the opposite side of this page, (unless charges are changed through your oral or written approval). If the device is under the iFone Repair Service warranty or an extensive examination contract, iFone Repair Service will perform maintenance and repairs under the terms of the warranty or extensive contract, with the correct proof of the device’s eligibility for such maintenance and repairs. You will be accountable for any supplemental charges that apply to your device’s warranty.

2. PAYMENT:

If your manufactured good is repaired under warranty or extensive contract without charge, you shall pay iFone Repair Service the exact amount shown the opposite side of this page. All charges must be paid in full when the device is given back to you. The assessed amount includes all parts, labor and certain transportation necessary for the repairing of the device plus any applicable tax, unless stated otherwise. iFone Repair Service may charge you for a consultation fee, plus any applicable tax, if iFone Repair Service examines your device, provides an assessed price for you, and you do not approve iFone Repair Service to undergo the repairing for the assessed charges. If iFone Repair Service concludes, while examining your device that repairs are needed due to lack of parts that are not provided by iFone Repair Service or are necessary due to harm caused by misuse or maltreatment, iFone Repair Service reserves the right to give the device back to you without any repairs and may hold you accountable for consultation fee and any applicable tax.

3. CONSENT:

If the repairs you have asked for require work/labor and/or parts not specified in the agreement, iFone Repair Service may revise the estimate with your approval. If you refuse that iFone Repair Service may change the charges, iFone Repair service may give you back your device and hold you accountable for the consultation fee shown on the opposite side, plus any applicable tax.

4. PARTS:

When repairing your device under iFone Repair Service’s warranty or extensive contract, iFone Repair Service may utilize new, used or refurbished parts. If repairing parts outside of warranty or extensive contract, iFone Repair Service may utilize new, used or refurbished parts. iFone Repair Service will keep the recalled part that is exchanged under the repairing service as its property, and the replacement part will become your own property. Replaced parts are usually fixable and are exchanged or repaired by iFone Repair Service for value. If any applicable law requires iFone Repair Service to give back a replaced part to you, you consent to pay iFone Repair Service the supplementary cost of the replacement part.

5. AFFILIATION WITH APPLE:

iFone Repair Service is not affiliated with Apple, Inc and is not an Apple Authorized Service Provider. Due to the non-affiliation, iFone Repair Service cannot recognize or honor any Apple warranty. Our employees may have Apple Certifications and are knowledgeable and capable of performing repairs on Apple Products, Apple does not recognize iFone Repair Service as an Apple Authorized Service Provider. Despite equal and comparable workmanship, any device that is not repaired by Apple or its affiliates may be considered tampering and affect their warranty coverage.

6. WARRANTY COVERAGE:

iFone Repair Service fixes your device under iFone Repair Service’s warranty or extensive contract, the repairs will be covered only by the terms of the warranty or extensive contract and applicable provisions of law. If your device is repaired outside of warranty, iFone Repair Service authorizes (1) that the repairs will be done in a skilled and proficient way and (2) that all parts used to repair your device will be free from defects in materials and workmanship for 90-days, but this does not include hard drives, headphone jacks, batteries, power buttons, volume buttons, and any parts repaired due to liquid damage. The warranty on parts is an express limited warranty. If a defect exists in a replacement part during the part’s warranty period, at its choice, Fone Repair Service will (1) repair the part, using new, used or refurbished replacement parts, (2) restore the part with a new, used or refurbished equivalent part, or (3) refund the fair market value of the part, as decided by iFone Repair Service.THIS WARRANTY AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED, WITH RESPECT TO THE REPAIR PARTS. IFONE REPAIR SERVICE SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES WITH RESPECT TO SUCH PARTS, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF IFONE REPAIR SERVICE CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED WARRANTY.

7. USE OF CONTACT INFO:

All customers serviced by iFone Repair Service or entities affiliated in business practices are subject to their contact information to be used solely for promotional use by iFone Repair Services for the services provided only by iFone Repair Service unless/otherwise by stating to be opted-out

8. LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IFONE REPAIR SERVICE AND ITS AFFILIATES, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM PERFORMANCE OF ANY REPAIR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA; OR ANY COSTS OF RECOVERING, PROGRAMMING, OR RESTORING ANY PROGRAM OR DATA STORED OR USED WITH YOUR PRODUCT AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON YOUR PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. IFONE REPAIR SERVICE SPECIFICALLY DOES NOT WARRANT THAT IT WILL BE ABLE TO (i) REPAIR YOUR PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, AND (ii) MAINTAIN THE CONFIDENTIALITY OF DATA. If any device should be mishandled and broken while in iFone Repair Service’s keeping, iFone Repair Service will make an effort to fix the damage done by means of repair. iFone Repair Service’s liability will be limited to the cost of the repair-affected component. If a device cannot be fixed or restored to its original state of functionality during the duration of iFone Repair Service’s keeping, iFone Repair Service will in good faith attempt to resolve the issue for the customer.

iFone Repair Service will not be accountable for any devices that show evidence of the following:

a. Liquid Damage – iFone Repair Service is not accountable for any devices which show evidence of liquid damage or has been exposed to liquid. If any product exhibits proof of liquid contact or damage from liquid contact, iFone Repair Service cannot guarantee the device will be returned in the same state or level of functionality prior to any service. Liquid damage is not covered by iFone Repair Service’s warranty or extensive contract. b. Data Loss or Corruption – iFone Repair Service is not accountable for loss or distortion of data or your restricted, proprietary or personal information or removable data. Prior to bringing in your device for repairing, make a backup copy of data and remove any restricted, proprietary or personal information and removable media such as Compact Disc, USB drives, etc..

OTHERWISE, IFONE REPAIR SERVICE’S LIABILITY FOR ANY AND ALL DAMAGE SHALL IN NO EVENT EXCEED THE PAYMENTS RECEIVED BY IFONE REPAIR SERVICE FOR SERVICES PROVIDED PURSUANT TO THESE TERMS. THE REMEDIES SET FORTH HEREIN SHALL BE YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY BREACH BY IFONE REPAIR SERVICE UNDER THESE TERMS AND CONDITIONS.

9. PRODUCT ABANDONMENT:

If you do not claim your device and pay all charges within ninety (90) days after notification from iFone Repair Service that your device has been repaired, iFone Repair Service will deem your device abandoned. IFone Repair Service will notify you at the phone number you provided when you authorized the repairing. iFone Repair Service may dispose of your device in accordance with applicable provisions of law, and specifically, may recycle or sell your product at a private or public sale without legal responsibility to you. iFone Repair Service reserves its statutory and any other lawful liens for unpaid charges.

10. SOFTWARE & DATA USAGE:

In the event that iFone Repair Service requires transferring information or installing software, you have the legal right to copy the information and agree to the terms of the software license, and you permit iFone Repair Service to transfer the information and accept such terms on your behalf in performing the service. Software installments and repairs are not covered by iFone Repair Service’s warranty.

You consent and comprehend that it is necessary for iFone Repair Service to collect, process and use your data in order to do the repairs and service obligations under these Terms and Conditions. iFone Repair Service will secure your information in accordance with iFone Repair Service Customer Privacy Policy.

11. GENERAL TERMS:

a) These Terms and Conditions are governed by the laws of the State of California (without giving effect to its conflict of law provisions). If any provision of these Terms and Conditions is held to be illegal or enforceable, that provision will no longer be part of the Terms and Conditions, and the Terms and Conditions will be enforceable as though that provision never was a part of them.

b) These Terms and Conditions are the only ones that govern iFone repair of your product. No other oral or written terms or conditions apply, including ones in any purchase order that you provide to iFone Repair Service. No one has the authority from iFone Repair Service to vary any of these Terms and Conditions.

c) iFone Repair Service products are subject to United States and foreign export control laws and regulations, and must be purchased, sold, exported, re- exported, transferred, or used in compliance with such export laws and regulations.

12. DEVICE UNLOCKING:

As of November 1, 2012, AT&T has shared their blackist with T-Mobile. While our IMEI unlock will technically unlock nearly ALL AT&T iPhones, we cannot guarantee that a blacklisted iPhone will work on other major networks. (i.e T-Mobile, Sprint, Verizon.)

We will not be offering a refund for any returns that are confirmed as a blacklisted device.
